CONDITIONS OF ACCESS AND SAFETY LIMITATIONS
For safety reasons and due to the nature of the nautical activity, access to the vessel is subject to compliance with minimum physical safety requirements.
The activity is not suitable for individuals who do not meet these safety requirements, including:
- Persons exceeding 120 kg in weight, where it may compromise safety on board
- Persons with reduced mobility that may prevent safe boarding or movement on board
- Pregnant women
- Babies or minors who do not meet the minimum safety requirements
- Persons whose age or physical condition, at the captain’s discretion, may pose a risk during the activity
Compliance with these conditions is mandatory in order to participate in the activity.
CUSTOMER RESPONSIBILITY
The operator shall not be held liable for any injuries, damages, or incidents arising from participation in the activity when:
- The client has omitted, concealed, or incorrectly declared relevant information regarding the physical condition, medical status, age, weight, or any other condition of the participants
- The client or any participant fails to comply with the established safety conditions or acts against the recommendations of the operator or the captain
- The client does not follow the safety instructions provided by the crew at all times
Participation in the tour implies the explicit acceptance of the inherent risks of nautical activities, including boat movement, waves, and changing sea conditions.
The client accepts that any omission, concealment, or incorrect declaration of relevant information may result in denial of boarding or cancellation of the activity for safety reasons, without the right to a refund when such situation is attributable to the client.
In the event that the client or any participant boards the vessel having provided false, incomplete, or misleading information, the client assumes full responsibility for any risks arising from such situation, releasing the operator from liability to the extent that the incident is related to the undisclosed or incorrectly declared information.
GENERAL TERMS AND CONDITIONS FOR PRIVATE BOAT TOURS
1. PURPOSE
These terms and conditions govern the booking of private boat tours and excursions offered by Seamallorcatrips.
By making a reservation, the user expressly agrees to these terms and conditions.
2. BOOKINGS
The tours are private, in accordance with applicable regulations in the Balearic Islands.
No individual seats or single tickets are sold.
Bookings can be made via website, external system (Turitop), WhatsApp, or telephone.
The booking is only confirmed once payment has been received.
Each reservation grants exclusive use of the boat for the client’s group on the selected date, preventing its sale to other customers.
3. PRICES AND PAYMENT
Prices refer to the full rental of the boat, not individual seats.
The price may vary depending on the number of people in the group.
This variation is due to operational factors such as:
higher fuel consumption
increased load on the vessel
greater wear and logistical requirements
Payment to secure the selected date must be made at the time of booking using the available methods.
4. CANCELLATION AND REFUND POLICY
Once the booking has been confirmed and payment has been made, no refunds will be issued under any circumstances.
This is due to:
the booking blocking the boat’s availability for other clients
the service being specifically prepared for the reserved date and group
In exceptional cases of force majeure (adverse weather conditions or operational impossibility), the following may be offered:
a date change, or
an equivalent alternative, subject to availability
5. SAFETY REQUIREMENTS
For safety reasons, this activity is not suitable for:
Persons over 120 kg
Pregnant women
Children under 5 years old
Persons with reduced mobility or access difficulties
Persons over 70 years old
The user declares, under their own responsibility, that they meet these requirements at the time of booking.
The company is not obliged to verify this information prior to boarding, and the client is responsible for ensuring that all information provided is accurate.
6. USER OBLIGATIONS
The user agrees to:
Provide truthful and complete information at all times
Comply with the stated safety requirements
Follow crew instructions at all times
Refrain from consuming alcohol or substances that may compromise safety
7. LIABILITY
Participation in the tour is at the user’s own responsibility, confirming that they are in suitable physical condition.
The company is not responsible for incidents arising from:
failure to comply with safety rules
inadequate physical condition of the user
false or incomplete booking information
consumption of alcohol or substances
In the event of a clear breach of safety requirements, the company reserves the right to deny boarding without any refund.
8. MODIFICATIONS
Schedules, routes, or conditions may be modified for safety reasons, weather conditions, or force majeure.
9. MINORS
Minors must be accompanied by a responsible adult at all times.
10. APPLICABLE LAW
These terms are governed by Spanish law.
